Orange and Lemons

The band Orange and Lemons is definitely one cool local act with a sound that hints of new wave groups like The Smiths, something relatively fresh for the current crop of Filipino bands. “Hanggang Kailan” has made its mark, gaining good radio playtime; and with their song “Pinoy Ako” used in the Pinoy Big Brother reality show, Orange and Lemons is sure break new grounds in OPM.

    Orange and Lemons cleared issues on alleged similarity in melody of its current hit “Pinoy Ako” to “Chandelier,” an original song of the ‘80s band The Care.

    “As a musician who can transcribe music note for note and having an idea about technicalities, I can confidently say they are two different songs,” Orange and Lemons’ vocalist and guitarist Clem Castro told Manila Bulletin via text message when asked for clarification.

    Star Records’ Jamie Hipe admitted that the band may have been influenced by The Care but after studying both songs they resolved that each has its own identity. “We studied the two songs and concluded that they are two different songs. Orange and Lemons may have been influenced by The Care but no, they did not copy The Care’s song. Yes, they wrote the melody and used ‘Chandelier’ as their peg,” stated Jamie of Star Records.

    This negative observation began circulating last month inside the band music circle but it’s only now that the band has made a comment on it.

    “Pinoy Ako” was a collaboration between the band Orange and Lemons and songwriter-record producer Jonathan Manalo who told the Bulletin that he only penned the lyrics of the song and entrusted the rest to the band.

    “I can’t comment as of the moment because the melody and arrangements are all from Orange and Lemons. Though I produced the record, there hasn’t been any discussion between me and Orange and Lemons about a certain song called ‘Chandelier.’ I’ve given them 100 percent creative freedom to interpret and arrange my song,” Jonathan disclosed.

    The songwriter added, “After they (members of Orange and Lemons) finished the song, I had the assurance that it was from an original material.”

    Orange and Lemon’s Clem may have been irked by Bulletin’s inquiry prompting him to give the following message: “Do you actually think/believe that the melody lines are similar? You know Star Records will not declare it as they did without consultation and deliberation, which believe me, they already did.”

    Orange & Lemons is composed of Clem Castro (guitars and vocals), Mcoy Fundales (guitars and vocals), Ace Del Mundo (drums), and JM Del Mundo (bass).

Remember when guys from the shows like American Idol and Rockstar INXS…they make sure that they could compress the songs let’s say 1-2 minutes atleast. Even if songs were chopped or arrange it’s still the same.In the case of Orange and Lemons they really have the same beat and how each line seems to fit every words of the song “Chandeliers” minus the chorous. Another thing is the title of the Band. They call themselves Orange and Lemons while the The Care’s album which has the track “Chandeliers” is “Diamonds and Emeralds” coincidence I don’t think so…. probably which led to the idea that they should name their band something with ?????? and ?????. get what I mean.     anyway, the important thing here is if you like the song and it makes you happy then you wont care if its copied or not. to those BITTER, i suggest that you start practicing and find your image (from other foreign bands) to sell your stuff….ok?

    one more thing… Pinoy Ako from PBB is not their only song. check out their latest album ‘STRIKE WHILST THE IRON IS HOT’ and also their first album ‘Love in the Land of Rubber Shoes’ which i think is even better than the recent one. grab a copy you wont regret it….

  47. I like OnL, ever since I heard them at a UP concert 2 years ago. Hearing about the issue regarding the ‘Pinoy Ako’ song saddens me, that such a talented band would resort to copying another band’s music. Kaye Villagomez’s article shows that OnL doens’t seem to care about it much. Sayang, ang galing pa naman nila.

    To the guy/girl who posted a reply under the name napadaan_lng (oct. 15), it’s not about being sikat or appealing to the masa. It’s about talent and honesty. Bakit ang ibang banda sumikat without having to copy? Some bands do remakes or spoofs, but they acknowledge that the material is not their own. I don’t think anyone is bitter, but I don’t think you realize the implications of the situation. It can make or break the group, and have them branded as music stealers. Plagarism taawag dun.

    If OnL would come up and say that they indeed used The Care’s song, and apologize, that’s one thing. It’s another if the band would act as if they gave The Care a favor by exposing their song. Think of it. If The Care isn’t popular at all, then no one would have noticed the striking similarity of ‘Pinoy Ako’ and ‘Chandeliers’. Then walang issue. But someone did.

    I really have nothing against OnL because like I said, I’ve heard them even before they went mainstream, way before this issue with ‘Pinoy Ako’ came about. My brother knows these guys personally and he can attest to the group’s talent. But it’s sad that fame would go into a their heads that they wouldn’t care about copyrights and such. I hope it wouldn’t create too much problems for them, because it would really be such a waste.

    Ok lang mag-remake, ok lang gamitin ang chorus ng isang kanta for another (don’t we see it all the time with rap/hip-hop songs?) PERO dapat isipin na 1) me permission nung original artist na you can use that, preferably written consent 2) acknowledge ng band that it’s not their original song, kahit part lang.

    Respect lang for your fellow musicians and artists.

    binebreak lang yung mga older “influences” para makuha yung sound while avoiding the disaster of plaguarization issues.

    pakinggan nyo ang kabuuan using a good headset before judging it. hindi ako music expert, but i think while there are similaries, may kakaibang original character yung sa Orange and Lemons.

    Chandeliers is more Indian-ish, and i have no idea what to call it chord or note, yung pangatlo pa lang, iba na.

    I don’t think they “broke” the song, (a term i heard advertising music people use on tv) they fixed it.

    And as for the propriety of improving upon Western things, let’s consider everything our culture is. We are, in whole, exactly the situation this song is in. A product of various colonial influences made better by our Filipino ways.

    The jeepney, which we are supposed to be proud of, according to some old english text book we used way back.

    Our democracy. Our education system. Our religions. The song has been made even more symbolic of the true meaning of being Pinoy. And I don’t find this at all a negative development.

  51. This is a sad affair not only for Paul Simpson and Ian Broudie but to the entire filipino community since the putative song in question has been flagrantly plagiarized.
    If the song were about feelings, emotions, topics of the day then maybe some or if not, most would have felt they could have let it slide except those who are personally involved. However, this song talks about the modern filipino, as of what PBB depicts, maybe its modern lifestyle…
    This song, has become quite an anthem to the simple and ordinary filipino because they found pride in it and they somehow see themselves in it that they are top class and can compete with the global changes the world has to offer.
    In this regard, for those that defend or support ONL or for those whose dreams were shattered and are in denial then basing things on an academician’s point of view….allegedly, they did not violate the 7 chord progression rule regarding plagiarism.
    I hate to burst the bubble but the 7 chord progression rule, in landmark cases decided by foreign courts under the Intellectual Property Rights which have been in actual existence post or pre-world war 1, this is a flimsy defense since the pattern could be changed anytime by a fret or a half-note on the seventh note.
    Presently, under the 8 chord progression based on the drum and baseline, if the song or composition in question fails to change at the 8th base and drum progression then it is a vital requisite to be considered as a plagiarized material not discounting the facts of testimonies of credible witnesses and “scholars” to that effect.
    This is what admittedly happened during the course of this song.
    The worse part in this case is for the band to not give credence to where the song was allegedly “inspired” from so as the real composers would be deprived of their royalties and their dignity.
    Mind you, it’s not only our dignity and credibility as a songwriter that is in question but our respect to other’s intellectual property rights as well.
    Cueshe, Session Road etc. may not be getting much attention because their songs dealt with corporeal, if not, things which do not appeal to a filipino’s sense of patriotism. However, ONL’s song just hit the x on the spot because it appeals to filipino pride in general.

  59. I really love the sound of this band, in fact, they’re the staples in my soundlist right now. Their music is reminiscent of The Smiths, the housemartins, railway children and THE CARE!!! which has been the buzz around town today.

    Frankly speaking, when I compared OAL’s “pinoy ako” with the care’s “chandelier”, The similarity is cunningly obvious (starting wiht the hypnotic intro up to the double time snare drumming, I even hummed the lyrics and it fitted well) sad to note that some cried foul!!!!

    I am a newwave purist even up to neverheards of the british music scene. (by the way, the song “chandelier” is from the care”s album entitled “Diamonds and Emeralds”, this, according to Paul Simpson, the other half of the duo, should not be released after all.) I think music influence should have boundaries, creativity, per se, would not be creativity anymore if one tends to lean and not deviate from something that is already existing.

    Still, I commend the courage of the guys in OAL because they were in the forefront of the rediscovery of this new wave genre. I still believe in this guys, just next time, be careful with the songs you choose. I do not want you guys to be in the dark, -literally!!! —archangel

    Sana sinabi nalang nitong mga bands na ito na inspired sila ng mga favorite bands nila and wag na sabihin “pasalamat pa ang the care at pinasikat ang kanta nila” wag naman ganyan dude, original is original. walang kopyahan. infairness magaling naman kayo sa musika. sana next time (kung meron pa) sariling komposisyon na talaga. wag na mag comment pa na tipong iniinsulto nyo ang the care.

    just to correct some errors here the band’s name was Care.. not The Care, there’s a difference…

    someone says here (salbakuta) that before Lotus Eaters were formed, Care was their band… None of the members of Care duo was a member of lotus eaters…two legends of the liverpool scene during the 80s ian broudie and paul simpson came from different bands… Wild Swans and Broudie, well there’s a lot (original mirrors) na lang and has been a producer of echo and the bunnymen, and icicle works…Lotus Eaters was Jeremy Kelly(with Simpson on Wild Swans) and Peter Coyle…

    OnL i’ve heard first was ok due to the very observed influences…. Listen and sing to music of OnL and not appreciate The Smiths or Morissey, then you’re just like the lot a fucking bunch of puppets.. that’s the great effect of publicity and idiot box(tv)..

    Ang tagal na ng Session Road, pero ever since wala silang significant impact. Cueshe is a show band. Just like Oranges & Lemon, they are desperate for a hit, so they plagiarize.

    In time, malalaos din sila kung patuloy nilang gagawin to, which just supports the fact that they just don’t have ‘it’ para tumagal. One-hit, two-hit wonders, I don’t care.

    Sa mga kumukonsinte ng pangongopya, well, you are the typical Pinoy. What I’m saying doesn’t apply to crab mentality, kasi they really did something shameful and wrong, the irony of “Pinoy Ako”… palitan na natin yung pagiging ignorante at mangmang natin, lumang Pinoy na yan.   85. WOW! The band and their music really rock. I memorized all the songs in both of their albums and I LOVE EVERYTHING! Gosh, I was so happy when they went to UERM and I got to see them face to face (closer than as I was used to), as in! I was so excited then… JM and Ace are gorgeous and I love them both! I like seeing McCoy and Clem playing their guitars… I love these guys a lot… I would be dying to see them again…
